До вхождения в состав Союза Union 31 штат управлялся как территория или ее часть. Прецедент в создании территорий был установлен в 1787 Ордонансом о создании Северо-Западной Территории Northwest Territory в регионе, расположенном между реками Миссисипи Mississippi River и Огайо Ohio River. Он предусматривал защиту основных гражданских и политических прав и свобод жителей и в последующем прием в состав Союза в качестве самостоятельного штата.
